Deposits & Scheduling

A 50% deposit is required to secure project scheduling, purchase materials, coordinate labor, and begin project preparation. Project dates are not reserved until the deposit has been received.

Because BackyardConstructs often purchases materials, schedules labor, reserves equipment, and performs project planning immediately after booking, deposits are not automatically refundable.

Cancellation Policy

If Customer cancels a project after acceptance of a proposal, BackyardConstructs shall be entitled to retain any portion of the deposit necessary to cover materials purchased, labor scheduled, design work performed, administrative costs, permit fees, equipment reservations, and any other project-related expenses incurred prior to cancellation.

If cancellation occurs within fourteen (14) days of the scheduled project start date, the deposit shall be presumed earned and non-refundable except for any amount exceeding actual costs incurred by BackyardConstructs.

Custom-ordered, special-order, or non-returnable materials are non-refundable once purchased.

Any refund, if applicable, will be determined after deducting all project-related costs and expenses incurred prior to cancellation.

Rescheduling

We understand plans change.

Rescheduling requests made fourteen (14) or more days before the scheduled start date will be accommodated whenever possible based on availability.

Requests made less than fourteen (14) days before the scheduled start date may require a new project date, additional scheduling fees, or a new deposit depending on labor and material commitments already incurred.

Weather Delays

Outdoor construction is weather dependent. BackyardConstructs reserves the right to delay, suspend, or reschedule work due to weather conditions, unsafe site conditions, material shortages, or circumstances beyond our control.

Any deposits and payments will automatically transfer to the rescheduled project date.

Existing Site Conditions

BackyardConstructs makes no guarantee regarding existing site conditions, drainage patterns, soil movement, settling, erosion, root growth, underground obstructions, utility locations, or pre-existing construction performed by others.

Additional work required due to unforeseen site conditions may result in additional charges and will be discussed with the Customer before proceeding.

Materials Disclaimer

BackyardConstructs purchases materials in bulk and allocates them across projects as needed. Customers are charged only for the materials required to complete their project, not for full units, rolls, pallets, or supplier minimum purchase quantities.

Any unused or leftover materials remain the property of BackyardConstructs unless otherwise agreed to in writing.

Workmanship & Warranty

Customer agrees to inspect all work upon substantial completion.

Any concerns regarding workmanship, installation, damage, or deficiencies must be submitted to BackyardConstructs in writing within three (3) calendar days of project completion.

Failure to provide written notice within this period constitutes acceptance of the completed work as satisfactory and complete.

BackyardConstructs agrees to correct verified workmanship-related issues reported within the inspection period. This warranty does not cover normal settling, drainage changes, weather-related conditions, material variations, damage caused by third parties, pets, irrigation systems, landscaping activities, improper maintenance, acts of nature, or customer preference changes after installation.

Any repair obligation shall be limited to reasonable repair or correction of the affected area. BackyardConstructs shall not be required to replace an entire project when a localized repair will reasonably address the issue.

BackyardConstructs' liability shall be limited to the amount paid for the specific portion of work performed.

Construction Variations

Customer acknowledges that construction and landscaping work may contain minor variations in appearance, grade, alignment, color, texture, pattern, or finish due to existing site conditions, natural materials, manufacturer tolerances, and the limitations of working with existing structures and landscapes.

Such variations shall not be considered defects so long as the work is performed in a professional and workmanlike manner.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
